Terms & Conditions

 

The following terms and conditions are an agreement between you and CallDawaai (“CallDawaai,” “we,” or “us”), as well as the CallDawaai applications, services, and mobile applications (collectively, the “Services”) on/in which these Terms of Use are posted or referenced. These terms of service (the “Terms of Service”), along with our Privacy Policy, govern your use of the Services, whether you are a registered user or not.

You agree to the terms of this agreement, including the information practices disclosed in our privacy policy and the use restrictions in the acceptable use policy, and to resolve any dispute you may have with us or the services in Pakistan, by using or otherwise accessing the services and/or registering with us. You will not be able to use the services if you do not agree to this agreement. Please be aware that the Services are provided “AS IS” and without guarantees. If you are opening an account or using the Services on behalf of another person or entity, you indicate that you have been allowed by that person or entity to accept this Agreement on their behalf.

  1. About Us

 

While you can browse portions of the Services without registering with us, you must register as a member and authorise the use and use of your information for the purposes of allowing us to deliver the Services and as otherwise indicated in our Privacy Policy.

 

You acknowledge that, while some Content may be provided by medical professionals, the provision of such Content does not create a medical professional/patient relationship, and does not constitute an opinion, medical advice, diagnosis, or treatment, but rather is provided to assist you in finding appropriate medical care from a doctor, dentist, or other healthcare specialist.

 

 

“Content” means content, text, data, graphics, images, photographs, video, audio, information, suggestions, guidance, and other materials provided, made available or otherwise found through the Services and/or Site, including without limitation Content provided in direct response to your questions or postings.

We make no guarantees, representations, or warranties, stated or implied, about professional qualifications, skills, work quality, price or cost information, insurance coverage or benefit information, or other content available through the services. We will not be liable to you or anyone else for any choice you make or action you take based on such content. Furthermore, any individual mentioned or available through the services is not endorsed or recommended by us in any way.

  1. Medical advice will not be provide by CallDawaai

 

The Content you gain or receive through the Services from CallDawaai, its employees, contractors, partners, sponsors, advertisers, licensors, or otherwise is primarily for informative, scheduling, and payment purposes. All medically relevant information, including that posted on the CallDawaai blog, official CallDawaai social channels, CallDawaai emails and text messages, and CallDawaai advertising, is defined primarily for educational purposes.

The content, whether given by or via the use of the services or through any other communications from CallDawaai, is not meant to replace professional medical advice, diagnosis, or treatment. Because of something you may have read on the site, do not reject, avoid, or delay seeking medical advice from a trained healthcare provider. Do not use the services if you require immediate medical attention. If you have a medical emergency, call 1122 and a healthcare professional right away. You are solely responsible for your use of the content. Nothing on the site or in any services is intended to be, and should not be construed as, the practise of medicine, dentistry, nursing, or other professional healthcare advice, or the provision of medical care.

Any specific tests, Healthcare Providers, methods, opinions, or other information that may appear through the Services are not recommended or endorsed by us. You do so at your own risk if you rely on any Content offered through the services.

  1. There will not be a doctor patient relationship

 

The use of the content, whether provided by or through the use of the services or any other communications from CallDawaai, including, but not limited to, the “find a doctor” feature, CallDawaai blog, official CallDawaai social channels, CallDawaai emails or text messages, or any assistance we provide, does not create a licenced medical professional/patient relationship.

We have no control over and cannot guarantee that any Healthcare Provider will be available at any given moment.

We shall not be liable for any injury resulting from cancelled or otherwise unfulfilled engagements, or any other injury resulting from or related to the use of the Site or Services in any way. You should conduct your own investigation before choosing a Healthcare Provider by calling the appropriate licencing or certification authorities to confirm listed credentials and education, and by confirming information about a specific Healthcare Provider with the Healthcare Provider’s office, your current Healthcare Providers, and other sources.

 

  1. Authorization and Acknowledgement

 

You realise that when you use the Site and Services to find and arrange appointments with Healthcare Providers, you are agreeing to the following:

 

You are ultimately responsible for choosing your own healthcare provider.

 

CallDawaai makes every effort to ensure that Healthcare Providers only use the Services if they have all active licences required by law to practise the specialisations of the services they offer. CallDawaai reserves the right to reject Healthcare Providers who, in CallDawaai’s opinion, have acted inappropriately or unprofessionally.

Based on the information you supply to us, we will present you with lists and/or profile previews of Healthcare Providers who may be suitable to provide the healthcare services you seek. These lists and/or profile previews may also be based on other criteria in order to aid in the identification of Healthcare Providers and to enable the maximum choice and diversity of Healthcare Providers engaging in the Services but CallDawaai does not recommend any Healthcare Providers, and does not make any representations or warranties with respect to these Healthcare Providers or the quality of the healthcare services they may provide.

  1. The services and content as informational and educational resources

 

We make the Services available to consumers and healthcare providers as an educational and informational resource. We may have Content posted through the Services reviewed by our editorial professionals, but we are not obligated to do so. It’s worth noting, though, that the timeliness, accuracy, and completeness of any or all of the Content can’t be guaranteed. Neither the writers, editing staff, nor any other party involved in the development or publication of this work can guarantee that the Content contained herein is true or full, and they will not be liable for any mistakes or omissions, as well as the results produced from the use of such Content.

Healthcare Provider Content is provided by the Healthcare Provider and/or office personnel, as well as data gathered from a variety of other sources that the Healthcare Provider may or may not corroborate. Such content is regularly updated, and it is possible that it will become out of date, incomplete, or erroneous. Neither the Site nor CallDawaai offer any advise or certification regarding any specific Healthcare Provider. You should independently verify any such Content.

The techniques, products, services, and devices mentioned and/or promoted through the Services are not appropriate for all people, patients, or clinical situations. Any paid or unpaid products, services, or devices advertised on the Services by advertisers, sponsors, or other participants are presented for your awareness and do not necessarily imply, and we make no claims as to, safety or appropriateness for any particular individual or prediction of effectiveness, outcome, or success.

 

  1. Registration

 

You must provide an e-mail address and establish a password as part of the registration procedure. These are your credentials for accessing the only-available-to-members Services (“Credentials”). You should keep your Credentials to yourself and not provide them to anyone else. If your password has been stolen or compromised, you must immediately alert us by sending an email to support@calldawaai.pk

  1. Your personal information

You must provide certain basic information about yourself in order to register. You may also choose to voluntarily disclose additional information in order to benefit of all of the Services we offer. Our Privacy Policy explains how we may use, share, and maintain your information, such as your name, address, NIC, and contact information; insurance information; medical history and current needs; billing information; and other information that is either requested by CallDawaai or voluntarily provided.

You permit CallDawaai, its employees, agents, and others working on its behalf to use and/or disclose such information in line with our Privacy Policy by entering such information. Please read the Privacy Policy carefully before using the Services since your consent to it is implied by your use of the Services.

If you choose to submit information into a medical history form on behalf of yourself or a third party from whom you have obtained consent to supply such information, you permit us to submit that information to the designated Healthcare Provider at your request.

You also agree that the data or information you supply on a Medical History Form may be used by CallDawaai in compliance with our Privacy Policy.

  1. Your responsibilities

 

Even though the Services are given free of charge, you will be responsible for any normal, customary, and other expenses for any medical or related services supplied by Healthcare Providers. Any dispute between you and any Healthcare Provider arising out of any transaction hereunder must be resolved entirely between you and the Healthcare Provider.

You are responsible for all usage of the Services and any use of your Credentials, including use by those who have access to your Credentials.

You may not use the Site in any way that harms, disables, overburdens, or impairs our servers or networks, or interferes with anyone else’s use and enjoyment of the Site or Services. You may not use hacking, password mining, or any other means to gain unauthorized access to any of the Services, user accounts, computer systems, or networks.

In addition to our rights under these Terms of Use, we reserve the right to take any legal action and implement any technological means necessary to prevent violations of these Terms of Use or our Acceptable Use Policy.

Responsibilities of Healthcare Providers or Medical Industries

If you are a Healthcare Provider or other person or entity in the healthcare or medical industries, regardless of whether you are a member or schedule or intend to plan appointments using the Services, you accept and accept that:

  1. You will not use the Services to view, access, or otherwise use price, availability, or other Content for any purpose other than your own personal use as a patient or potential patient, whether directly or indirectly.
  2. You will not use the Services to establish, attempt to establish, or enforce, directly or indirectly, any agreement or coordination of the prices charged for any product or service; the kinds, frequencies, or amounts of any product or service offered; or the customer or customer categories for any product or service, or otherwise engage or attempt to engage in price fixing, output restriction, or any other form of price fixing, output restriction, or any other form of price fixing, output restriction, or any other form of price fixing, output restriction, or any other
  3. You will not use the Services to engage in any anti-competitive, deceptive, or unfair business practises, or to violate any relevant antitrust, competition, or consumer protection laws or regulations, directly or indirectly.

 

  1. Changes to the services & new services

 

We may introduce new services to the Services from time to time, substitute new services for existing Services, or discontinue or stop current Services. The Services will provide information about the new services, and the usage of the new services will be controlled by this Agreement. You agree that CallDawaai will not be liable to you or any third party if any of the Services or portions thereof are suspended or discontinued.

 

  1. Termination

 

We may terminate and/or suspend your registration immediately, without notice, if there has been a violation of this Agreement or other policies and terms posted on the Site or through the Services by you or by someone using your Credentials. We may also cancel or suspend your registration for any other reason, including inactivity for an extended period. CallDawaai shall not be liable to you or any third party for any termination of your access to the Site and/or the Services. Further, you agree not to attempt to use the Site and/or the Services after any such deletion, deactivation or termination (provided, in the case of deactivation due exclusively to your inactivity, you may be permitted to re-register).

  1. Changes to These Terms of Use

We reserve the right to amend these Terms of Use and the other documents that make up the Agreement at any time as we see fit. We will post the modified terms on the Site and may try to contact you in other ways if the terms change. Following such posting, your continued use of the Site and/or the Services constitutes your affirmative acknowledgement of the Terms of Use or other applicable Agreement document, the modification, and agreement to abide and be bound by the Terms of Use or other applicable Agreement document, as amended. We recommend that you examine our Terms of Service on a regular basis.
